General Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all inquiries submitted via laurea.ink and the resulting tattoo contracts between me, Laura Molter Mohnstr. 30, 01127 Dresden, and the respective client (hereafter "the Client"). Deviating conditions of the Client are not recognised.

2. Inquiry and conclusion of contract

Submitting an inquiry via the contact form does not yet constitute a binding offer or booking. A tattoo contract only comes into effect upon my explicit written confirmation (usually by email).

3. Right of withdrawal for consumers

Consumers have a statutory right of withdrawal. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession. Right of withdrawal You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract. To exercise your right of withdrawal, you must inform me (Laura Molter, Mohnstr. 30, 01127 Dresden, email: laurea.ink@gmail.com) of your decision to withdraw from this contract by a clear written statement. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. Consequences of withdrawal If you withdraw from this contract, I shall reimburse all payments received from you, including the deposit, without undue delay and no later than fourteen days from the day on which I receive notification of your withdrawal from this contract. For this repayment I will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. If you requested that the services begin during the withdrawal period, you shall pay me a reasonable amount corresponding to the proportion of the services already provided up to the time you notify me of the exercise of the right of withdrawal compared with the full scope of the services provided for in the contract (e.g. for drafts and preliminary drawings already produced). Early expiry of the right of withdrawal The right of withdrawal expires early if I have fully provided the service (i.e. the tattoo has been completely executed) and only begun performance after you gave your express consent to do so and at the same time confirmed your knowledge that you lose your right of withdrawal upon full performance of the contract by me.

4. Minimum age

Tattoos may only be performed on persons aged 18 and over. The Client confirms at the time of booking that they are of legal age. I am entitled and obliged to request proof of identity (identity card or passport). Tattooing minors is not possible, even with the consent of a legal guardian.

5. Deposit

Upon confirmation of an appointment, a deposit of €50 may be due where applicable. The deposit is credited against the total price. It secures the appointment and covers my reservation and design work. If the Client cancels or fails to attend, any retention of the deposit is governed by § 7 of these GTC. Any statutory rights of withdrawal of the Client (§ 3) remain unaffected.

6. Final payment and payment methods

The remaining balance after deduction of the deposit is due on the day of the appointment, after the tattoo has been completed, unless otherwise agreed. Payment is made in cash or, by prior arrangement, by bank transfer. The final price depends on size, motif, effort, body location and technical difficulty, and is agreed before the appointment.

7. Cancellations, lateness and no-shows

Cancellations or rescheduling must be communicated at least 48 hours before the agreed appointment. In this case, one complimentary reschedule is possible; the deposit is transferred to the new appointment. For cancellations with less than 48 hours' notice, and in the event of a no-show without prior notice, I am entitled to retain the deposit as liquidated damages for my reservation and design work. The Client is expressly permitted to prove that I incurred no damage or substantially lower damage; in that case the deposit is refunded in full or in part. If the Client arrives more than 30 minutes late, noticeably under the influence of alcohol or drugs, or in a state medically unfit for tattooing, I am entitled to decline the appointment; in this case the appointment counts as a no-show and I may retain the deposit as liquidated damages in accordance with the preceding paragraph. I reserve the right to refuse future bookings in the event of repeated short-notice cancellations or no-shows.

8. Health and duty to disclose

The Client declares upon booking that no known contraindications exist at the time of the appointment, in particular no skin conditions in the area of the planned tattoo, no blood clotting disorders, no allergies to tattoo inks or care products, no pregnancy or breastfeeding, and no other medical conditions that preclude tattooing. The Client is obliged to inform me, unprompted and before the tattoo begins, of all circumstances relevant to the procedure, in particular the use of blood-thinning medication or numbing creams, allergies, pregnancy or breastfeeding, infectious diseases (e.g. HIV, hepatitis), epilepsy, cardiovascular conditions, acute infections and skin conditions. In case of doubt about fitness, medical advice must be sought before the appointment. I reserve the right to refuse or discontinue a tattoo for health reasons, without giving rise to any claim for damages.

9. Designs and refusal of commissions

Only motifs designed by me or approved by me are tattooed. Tattooing begins only once there is agreement on the motif. I am not obliged to accept every commission and may in particular decline motifs that are unlawful, discriminatory, harmful to minors, or incompatible with my own artistic or ethical principles.

10. Deviations from the draft and individual reactions

A tattoo is handmade work. The finished result may differ slightly from the draft shown beforehand due to skin texture, body location, size and individual healing; such design-related deviations do not constitute a defect. Even with proper execution, individual skin reactions or intolerances to tattoo inks may occur in rare cases; these are beyond my control and I am not liable for them. My liability for damages arising from injury to life, body or health under § 11 of these GTC remains unaffected.

11. Aftercare and liability

I provide the Client with written aftercare instructions after the tattoo session. Compliance with these instructions is the sole responsibility of the Client. I am not liable for complications resulting from improper aftercare, disregard of the aftercare instructions, or external influences. I am liable without limitation for damages caused by intent and gross negligence; for slight negligence only in the event of a breach of a material contractual obligation and limited to the foreseeable damage typical for the contract. Liability for damages arising from injury to life, body or health remains unaffected. I assume no liability for personal items brought along or for their loss or damage.

12. Copyright

All motifs and designs created by me are protected by copyright. Reproduction, distribution or imitation by third parties without my express written permission is not permitted. The use of photographs of the finished tattoo for portfolio and marketing purposes (website, Instagram, etc.) takes place exclusively on the basis of the Client's separate, voluntary consent, which may be withdrawn at any time with effect for the future (Art. 6(1)(a), Art. 9(2)(a) GDPR, § 22 KunstUrhG). Granting this consent is not a condition for concluding or performing the tattoo contract.

13. Touch-ups

The Client's statutory warranty rights (§§ 633 et seq. BGB) remain unaffected. Independently of these and beyond the statutory rights, I offer, as a voluntary additional service, one complimentary touch-up within nine months of the appointment, provided my aftercare instructions have been demonstrably followed. The touch-up appointment must be arranged within this period. Excluded are areas with an anatomically elevated fade rate (in particular fingers, palms, soles of the feet, elbows, inner knees) and changes caused by external influences (sun exposure, chlorinated water, scratching).

14. Governing law and jurisdiction

The law of the Federal Republic of Germany applies. For consumers, this choice of law applies only to the extent that the protection afforded by mandatory provisions of the law of the country in which the consumer is habitually resident is not withdrawn. The place of jurisdiction for disputes with merchants, legal persons under public law or public-law special funds is Dresden.
